Day 124 - 10 May 95 - Page 03

help you or not. I mean, if he can help you, you can go
through the bits which you consider important and see
whether he will accept those. If he cannot help you, then
there is no point. If it is apparent from the beginning
that he cannot help you, then there is no point in putting
       the whole lot.

  MR. MORRIS: Right.

MR. JUSTICE BELL: See how you go.

  MR. MORRIS: Yes.

                       MR. BEAVERS, recalled.
            Cross-examined by the Defendants, continued.

MR. MORRIS: Do you remember in the 1970s a book being written
by Matt Bowas and Steve Chain who visited franchisees all
over America, observed McDonald's courses at Hamburger
University, interviewed large numbers of people from
McDonald's and consumed over 2,000 hamburgers -- I do not
think that is relevant -- called "Big Mac, The Unauthorised
       Story of McDonald's"?
       A. Yes, I have heard of it and I have perused it. It has
been a number of years, quite a few years, since I have
       perused it.

  Q. Are you aware that they spoke to quite a lot of people
       connected with McDonald's?
       A. They did. It was unauthorised.

  Q. Yes. Was it originally going to be authorised and then
when the tenor of it was seen it was rejected or something
       like that, do you remember?
       A. I do not know the specifics, you know, surrounding the
fact that we did not, you know, bless the book, authorise
       the book.

  Q. Were you yourself interviewed or approached, do you
       remember?
       A. No, not for that, I do not recall.

  Q. I will try to go through this as systematically as possible
then. There is one question that is raised, it is about
McDonald's income from real estate, and some opinion being
expressed in Wall Street's leading fast-food service
       magazine -----

MR. RAMPTON: My Lord, I am not sure this has any relevance to
this case. There is nothing about real estate in the
       leaflet or in the Defence.

MR. JUSTICE BELL: What do you say this relates to?

MR. MORRIS: It relates to the Company's income and whether they
get more direct revenue from, effectively, real estate and
rentals rather than directly from the selling of
       hamburgers.

MR. JUSTICE BELL: What has that to do with the leaflet? Let me
