Day 009 - 08 Jul 94 - Page 05

1 transcripts which you can send to Dr. Neilson and anyone
else you want to get further instructions from. You will
2 not only be able to send it to them so they cannot only
see the plaintiffs' experts reports, but what they have
3 actually said in the witness box. You have several weeks
to find out what their response is. I do not want to seem
4 to be trying to bully you into it, but I can see so many
advantages from your point of view.
     5
MR. MORRIS: I understand that. Originally, the schedule
6 actually only had one day before the break for our
witnesses on nutrition in any event. So this would have
7 happened even if we had kept to the previous schedule,
which was likely to be impossible because of the slippage
8 in any event. So it is not a dramatic change.

9 MR. JUSTICE BELL: If it is crossing your mind I certainly do
not think you should be suspicious of McDonald's motives
10 in relation to this, because it seems to me to be a good
idea and I find it difficult to see any disadvantages from
11 your point of view. I can see quite a lot of advantage.

12 MR. MORRIS: Just one thing that bothers me a little bit is
Mr. Gregory, which is extremely important evidence, and if
13 some way could be found for him to come after the
              break----
    14
MR. RAMPTON: No. I explained that before; Mr. Gregory is
15 emigrating to New Zealand at the end of July.

16 MR. JUSTICE BELL: Yes. One can see, for instance, if we run
into time trouble, I can see how there would be no great
17 inconvenience if we came back to Mr. Oakley, who actually,
now I have looked at him, I think you could cross-examine
18 right now, because you are not on nutrition going to be
putting anything more to him than you are putting to
19 Mr. Preston. It is purely factual. It is information
provided by McDonald's as to the contents of their food.
    20
Let us get on with Mr. Langert. It is obvious to you that
21 at the end of the day I have to make a decision and
everybody has to abide by that. I am very strongly in
22 favour of this at the moment.

23 MR. MORRIS: Yes, we are broadly in agreement -----

24 MR. JUSTICE BELL: You will just have to trust me to look after
              your interests.
    25
MR. MORRIS: We broadly accept it.
    26
                              Mr. Langert, recalled.
    27 Cross-Examined by the defendants

28 MR. MORRIS: Mr. Langert, just a little bit on the relationship
between Perseco and McDonald's. Perseco is a legally
    29 separate entity ---
              A. Yes.
    30
         Q. -- from McDonald's. But it has a very close relationship
