Day 037 - 14 Oct 94 - Page 02

                                     Friday, 14th October, 1994

MS. STEEL: There are some pages here from the Diet, Nutrition
and Cancer, the green book that you asked for yesterday.
(Handed) We just wanted to bring up about the documents
that we put in the file that was going to be used in
cross-examination of Dr. Barnard. Apart from his book
none were specifically put to him. As we pointed out, the
transcript of the video was inaccurate and, as far as we
are aware, there are a large number of misleading and
inaccurate documents in there. I am not saying that is
the fault of the Plaintiffs specifically.

MR. JUSTICE BELL: I will not read any of it apart from when
I come back to look at the transcript of Dr. Barnard's
evidence, the parts which were put in cross-examination,
unless at any stage Mr. Rampton specifically asks me to
and persuades me that it is legitimate to do so, and if he
does seek to do that, I will hear you.

MS. STEEL: We would like to ask that, apart from the book
which was referred to, the other documents were removed
       from the trial bundles.

MR. JUSTICE BELL: That is probably the best thing,
Mr. Rampton. If we need to come back to them in any
context whatsoever, they can be put back in.

MR. RAMPTON: Yes, I did what one normally does in these cases
(and should always do) which is in relation to credit ask
questions based upon the documents. In the light of the
answers, I did not put the documents.

  MR. JUSTICE BELL: Yes.

MR. MORRIS: We call Peter Cox.

MR. RAMPTON: My Lord, before Mr. Cox gives evidence, I would
observe that, as so often, I have only got a selection of
Mr. Cox's references. I am afraid (and I believe) that
will be the same for your Lordship as well. In relation
       to his first statement, I have numbers 8, 10, 12, 13, 15
and 16. In relation to his second statement, I have 2, 3,
4 and 5. That is all.

MS. STEEL: Some of them are to be found in the trial bundles.
I do not think the other ones are going to be referred to.

  MR. RAMPTON: That is fine.

MR. JUSTICE BELL: When we come to -- you call Mr. Cox. We
will see whether there is any problem about documents.

MR. MORRIS: We call Mr. Cox, please.

                      MR. PETER DAVID COX, Sworn
                       Examined by the Defendants

MR. MORRIS: Will you give the court your full name, please?
       A. My full name is Peter David Cox.
