Day 038 - 19 Oct 94 - Page 04

I appreciate that, but, as you have probably gathered, I
am just mildly irritated if I have wasted a fair bit of my
       time.

MR. MORRIS: There was an extra couple of pages regarding
styrene. Did you get the styrene addition?

  MR. JUSTICE BELL: No.

MR. MORRIS: Again, that was part -- you have been served that
document from the Plaintiffs, you see, so they should have
an inclusion about styrene; otherwise I will hand you one.

MR. JUSTICE BELL: If it is only two pages I can sit here and
read that. I will rise until ten to eleven. You try and
identify with Dr. Millstone just where the additions are
insofar as you are unsure of them. I will have a look and
then I will come back and see where we go from there.

MS. STEEL: There is nothing changed before carrageenan.

MR. RAMPTON: That is not right, my Lord. What I might call the
"general introduction" has been rewritten, I take it in
the face of some of the things that Professor Walker has
       said.

MR. JUSTICE BELL: You identify the changes and tell me about
       them when I come back.

                      (Short Adjournment)

MS. STEEL: There is no change to the general introduction. I
do not know where Mr. Rampton got that idea from, but it is
wrong. The only changes before carrageenan are to the
footnotes. None of the numbers change before 106, which is
where carrageenan starts, but some of the footnotes have
       been expanded to include the whole title of the paper;
whereas before they just had the name of the author and the
journal it was found in, so that does actually put the
pages out. But there is no change to the text before
       page 31.

MR. JUSTICE BELL: Yes. What do you want me to do? You want me
to put this in the bundle?

MR. MORRIS: The new one, yes; I am just going to explain what
the changes are after page 31 in the new statement. The
new statement on page 31 ends with No. 107, reference
number 107. On page 32 there has been an additional couple
of paragraphs put in -- it starts on the bottom of page 31,
the paragraph starting "Walker has alleged". Basically,
the rest of that section has been altered, I think, to
incorporate points made by Professor Walker up to the new
page 33, second complete paragraph, the 1970 FACC Report.
I believe, from there onwards, it is exactly the same.

MR. JUSTICE BELL: Where is that 1970?

MR. MORRIS: The second complete paragraph on page 33; from then
onwards it is exactly the same.
