Day 040 - 21 Oct 94 - Page 05

deal with the question of amendment next week. I am
particularly keen that we should get through advertising
efficiently. I think if you have any time at the weekend
and Monday, Tuesday, Wednesday and Thursday to get yourself
ready for it, we will get through it more efficiently.

MR. RAMPTON: Yes. It would cause my witnesses a very great
deal of inconvenience if the advertising schedule were
       changed.

MR. JUSTICE BELL: What I would like to do is give you the time
for preparation next week, get through the advertising
witnesses efficiently, and then after that find a space for
arguing about the amendment to the Statement of Claim.

MR. RAMPTON: Yes, my Lord. I do ask now that the Defendants
should let us know -- I am reading from Mrs. Brinley-Codd's
note -- the order of their advertising witnesses.

MS. STEEL: There are only two. I do not think it will cause
Mr. Rampton any great hardship. We have not had the time
       to phone them.

MR. JUSTICE BELL: Have you given the identities of the two?

MS. STEEL: They know who they are.

MR. JUSTICE BELL: Can you tell me?

MS. STEEL: Sue Dibb and Juliette Gelatley.

MR. RAMPTON: I repeat my request that it helps me in organising
my cross-examination if the Defendants would be so kind at
some stage before the witnesses are called (and not the day
before) to tell us which order those two ladies are going
       to be called.

MR. JUSTICE BELL: When will they be called? Which week is it?

MR. RAMPTON: It is the week beginning 7th November.

MS. STEEL: We are not intending to keep it a secret. I do not
know why Mr. Rampton is making so much fuss about it seeing
       as there are only two.

MR. RAMPTON: I am not making a fuss. I am making a polite
request that the Defendants extend to us the same courtesy
and convenience as we have consistently done to them.

MR. JUSTICE BELL: I think you should tell Mr. Rampton at the
beginning of the week starting Monday 31st October what
your proposal is for when they are called. That gives you
another week and a bit and will give Mr. Rampton a week and
a bit before he has to cross-examine. That seems to me a
       fair compromise for both sides.

I did not speak as I did to invite advance discussion at
this stage, but really to clear the air, so perhaps we
could go on with Dr. Millstone now.
