     1   MR. RAMPTON:  My Lord, yes.
     3   MR. JUSTICE BELL:  Yes.  No doubt you will tell me, but what is
     4        the position of Mr. Hayden's statement?  Is it Civil
     5        Evidence Act or is it proposed that Mr. Hawkes will, apart
     6        from amending the figures, give evidence to the same
     7        effect?
     9   MR. RAMPTON:  He will, my Lord, yes.
    11   MR. JUSTICE BELL:  So do I ignore it as a statement in its own
    12        right?
    14   MR. RAMPTON:  My Lord, yes.  It has to be treated as an
    15        indication of what Mr. Hawkes himself will or may say.

    21   Q.   Mr. Hawkes, are your full names John Hawkes?
    22        A.  John Ivor Hawkes, yes.
    24   Q.   So the answer is, no.  You give your address as McDonald's
    25        Restaurants Limited, 11-59 High Road, East Finchley, London
    26        N2 8AW?
    27        A.  Yes.
    29   Q.   We have a problem in this court, several problems in fact;
    30        one of them is the acoustics are not very good, another is
    31        I sometimes do not speak as distinctly as I should, so can
    32        you keep your voice up, please?
    33        A.  I will try.
    35   Q.   If you do not hear what I say, please indicate that.  The
    36        third thing is give your answers by speaking rather than
    37        nodding if you want to say "yes" or "no" because it has to
    38        be recorded by that microphone.  That microphone is not an
    39        amplifier; it is a recording device.  Mr. Hawkes, are you
    40        the Chief Marketing Officer of McDonald's Restaurants
    41        Limited, one of the Plaintiffs in this case?
    42        A.  Yes, I am.
    44   Q.   When did you take up that position?
    45        A.  That particular position officially of about May this
    46        year.
    48   Q.   Was that because your predecessor, Mr. Michael Hayden, left
    49        the company?
    50        A.  Yes, it was. 
    52   Q.   When did you join McDonald's? 
    53        A.  12 years ago -- that would have been in October 1982.
    55   Q.   What age were you when you joined McDonald's 12 years ago?
    56        A.  I am 42 now; I guess I was 30, yes.
    58   Q.   What capacity did you have when you joined McDonald's in
    59        October 1982?
    60        A.  I was a Marketing Assistant within the marketing
