Day 044 - 02 Nov 94 - Page 04

that is not going to be pursued, you are content to rely on
other witnesses so far as other factors are concerned,
although Mr. Bateman does touch on other factors.

MR. RAMPTON: I know he does, but I am content to leave it to
others. If it is simply a question of trees, then I do not
need Mr. Bateman. If it is a question of whether the paper
making process adverse environmental effects, then I do
need Mr. Bateman, but I only propose to call him if the
Defendants, by some means or another, they having said that
they have abandoned Miss Carroll, are themselves proposing
       to lead any evidence.

MR. JUSTICE BELL: Thank you. What I would like is anything
that you wish to say at this stage on, firstly, the
question of Miss Carroll and Mr. Bateman; secondly, as to
       order of advertising witnesses and when they may be taken;
thirdly, the question of the length of any break between
such advertising witnesses as we can call at this stage and
going on to the question of amendment, and recycling and
       waste.

  MS. STEEL: As far as-----

MR. JUSTICE BELL: Miss Carroll and Mr. Bateman, first of all.

MS. STEEL: We would like to get advice, really. We have not
really had the chance to take advice.

MR. JUSTICE BELL: I would like you to get it as soon as you
can, simply because it is not just a question of whether
Mr. Rampton needs to call Mr. Bateman. Indeed, if you were
left in any doubt about that, it might be that he would
just call him, but if there is no need to call Mr. Bateman,
we have two days in the schedule which we can use for
something else. So it has that importance to know as soon
       as possible.

MS. STEEL: We will try to sort it out in the next couple of
       days.

MR. JUSTICE BELL: I would like you to let me know by the end of
this week, really, or the very beginning of next week.
What you, first of all, have to decide is whether you are
actually calling evidence, putting a positive case in the
sense of calling evidence, on the pulp processing side,
chlorine, and matters of that kind.

Then the question of order of witnesses.

MS. STEEL: We have spoken to Juliette Gallatley and Sue Dibb.
Fortunately, we had left Tuesday free, because we thought
there was a chance that this could over run, so we asked
       them-----

MR. JUSTICE BELL: Can you keep your voice up?

MS. STEEL: We asked Juliette Gallatley to come on Wednesday
morning, and then we were going to start Sue Dibb on
Wednesday afternoon and carry on for however long it took,
