     1        really.  We hoped that two and a half days would be enough
     2        for Sue Dibb, anyway.  But now that might be out of----

     5   MR. JUSTICE BELL:  I think the answer to that may be that,
     6        although, from the witnesses' point of view, the sooner the
     7        better, but one had better wait and see how you progress
     8        with your cross-examination of Mr. Green.

    10   MR. RAMPTON:  My Lord, if Mr. Green were to finish by the end of
    11        Thursday or early Friday morning, we have not actually
    12        stood Mr. Miles down for Friday; we have merely warned him.

    14   MR. JUSTICE BELL:  If Mr. Green were to finish tomorrow
    15        afternoon, it would be possible to proceed with Mr. Miles
    16        on Friday and Monday, come back to Mr. Hawkes perhaps on
    17        Tuesday 8th, and then there would be, hopefully, the rest
    18        of the week.  If Mr. Hawkes were finished on Tuesday 8th,
    19        or not too far into Wednesday 9th, we could have Miss
    20        Gallatley and Miss Dibb during the remainder of that week.

    22   MR. RAMPTON:  That would be the best of all possible worlds.  We
    23        have told Mr. Hawkes that he may be required next week.

    25   MS. STEEL:  We would want to finish Mr. Hawkes before starting
    26        our witnesses, obviously.

    28   MR. JUSTICE BELL:  I think that would be advisable.  I think he
    29        really must do his very best to have made such enquiries as
    30        he wants to by the beginning of next week.  If they are not
    31        complete, that may just be too bad, if he has progressed
    32        some way with them.

    34   MR. RAMPTON:  He knows that.

    36   MR. JUSTICE BELL:  If the position was that we had, therefore,
    37        finished advertising by the end of next week, by
    38        Friday 11th, my proposal would be that there is a break
    39        between Monday 14th and Friday 18th, for preparation for
    40        the remainder of recycling and waste and the argument on
    41        the proposed amendments, and that we come back to the
    42        argument concerning proposed amendments on Monday 21st, and
    43        then go straight on from that to the recycling and waste
    44        witnesses.  What do you say about that?

    46   MS. STEEL:  That sounds okay, but I wanted to ask about the
    47        skeleton argument the Plaintiffs were preparing.  They were
    48        going to do it last week.  Obviously, if we can have it
    49        before the week break, that gives us the chance to get
    50        advice.

    52   MR. RAMPTON:  I hope it is going to be served.  It is just now 
    53        having some amendments retyped, and I hope it will be
    54        served today.

    56   MR. JUSTICE BELL:  The purpose of the week break would be to
    57        prepare yourself on both aspects:  the application to amend
    58        and the remainder of the recycling and waste witnesses.
