Day 045 - 03 Nov 94 - Page 38

       before lunch.

MR. RAMPTON: Might I use that opportunity to make a polite
enquiry -- roughly speaking only, of course -- whether it
is thought that the cross-examination of Mr. Green might
finish today; if not, roughly whether it might finish
       tomorrow, because of Mr. Miles.

MR. JUSTICE BELL: We will break off there, anyway, Mr. Morris.
So you can come back again at two o'clock. What is the
best indication you can give me of cross-examination?

MR. MORRIS: I think we will probably finish around about lunch
time tomorrow. I do not know what means for Mr. Miles.

MR. JUSTICE BELL: That is really up to Mr. Rampton. It no
doubt depends on how easy it is to communicate with
Mr. Miles. Is he in London?

MR. RAMPTON: My Lord, yes, he is. He is a busy man and, if it
were possible to do so, given that indication, I should
quite like -- I am subject to correction by
Mrs. Brinley-Codd -- to stand him down for tomorrow,
because "about lunch time" -- I see head shaking going on.

MR. JUSTICE BELL: What I would like you to do is make some
enquiry, because do you remember that Professor Keen was
kind enough to say that, if he got a phone call about
one o'clock, he would come from his hospital at two? In
fact, he came anyway, I seem to remember, on that day.
Unless there is desperate inconvenience to Mr. Miles doing
that, I would be loath to lose what might be half a day.
We might be able to give him a telephone call at about 12
       noon rather than one o'clock.

                      (The Short Adjournment)
                                                    2.00 p.m.

MS. STEEL: I think you have mentioned that you were targeting
your advertisements at heavy users of McDonald's; is that
       right?
       A. Yes. The greatest potential for us to increase our
sales are those that are already heavy users of the quick
service restaurant and, in particular, heavy users of
       hamburger restaurants.

  Q. And heavy users of McDonald's?
       A. That is correct.

  Q. What do you mean by a "heavy user"?
       A. Usually, the definition is someone who comes and eats
out once a week at McDonald's, is a heavy user, once a week
       or more.

  Q. Once a week or more?
       A. That is correct.

  Q. You also have a category that you call a "super heavy
       user", do you not?
       A. Yes.
