Day 045 - 03 Nov 94 - Page 40

MR. JUSTICE BELL: Well, Ms. Steel is on her feet.

MR. MORRIS: We want to bring that up first, because it does
relate directly to that, and we might as well get that.
       I cannot find it now.

MR. JUSTICE BELL: Does it have to come before Ms. Steel's
       point?

MR. MORRIS: Yes. It is part of the same point. It is number 5
of the documents behind the Sue Dibb document.

MS. STEEL: (To the witness) If you can leave that open?
       A. Where would I find what you are asking me to look for?

MS. STEEL: The pale blue volume.

MR. RAMPTON: My Lord, here we are again, I am afraid. This
looks to me as though it is just a newspaper article.
I say no more than that at this stage.

MR. JUSTICE BELL: Just look at the document, first of all.

MR. MORRIS: I do not know which tab it is.

MS. STEEL: Behind Sue Dibb there should be an index.
       A. Yes.

MR. MORRIS: Do you have the document number 5 in front of you?
This is from -- it says "Chicago magazine". It has not got
on it. This actually is "Advertising Age", I think it is.

MR. RAMPTON: I am sorry, my Lord. If there is a question to be
asked, let it be asked. This is an inadmissible document.
It is a newspaper article. It is not written by McDonald's
or by Mr. Green. So far as I know, there is no witness
coming to court to prove any fact that might be asserted in
it. If Mr. Morris has a question, let him put to
Mr. Green; if he does not accept the answer, then let
him draw Mr. Green's attention to the document to see if
Mr. Green wishes to change his answer.

MR. MORRIS: If we just read the first five paragraphs?

MR. RAMPTON: No, that is not the right way to do it.

MR. MORRIS: Are we not allowed to even ask the witness to read
       the document now?

MR. JUSTICE BELL: Yes, you can, but just ask him to look at it.

MR. MORRIS: That is what I said.

MR. JUSTICE BELL: Is it on the right or on the left? I accept
when you said "read", you meant "read to yourself", but
       make it absolutely clear.

MS. STEEL: It would help if Mr. Rampton just stopped making
unnecessary interruptions. He did ask him just to read it.
