Day 078 - 26 Jan 95 - Page 05

MR. RAMPTON: Yes, they are here. Would your Lordship like to
       have a look at them?

MR. JUSTICE BELL: No, I would not. It may very well be that
no-one will ask me to look at them. On this occasion
de benesse (which may be Latin but is one of the most
useful phrases in the administration of justice in this
country) I think the Defendants ought to see them since
they are here and if it is possible for Brinley-Codd to
find five minutes towards the end of mid-day adjournment --
is there a difficulty about that?

MR. RAMPTON: My Lord, I do not believe that she is in a
position to explain what they are.

MR. JUSTICE BELL: Let the Defendants have a look at them at the
beginning of the mid-day adjournment at 1 o'clock or
       thereabouts.

MR. RAMPTON: They can save time by starting to look at them
       now.

MR. JUSTICE BELL: We will see how we go.

  MS. STEEL: Thank you.

                      LOUIS DAVID WALKER, recalled
                     Cross-examined by the Defendants

MS. STEEL: Mr. Walker, until 1990 you said McKey was owned by
       McDonald's; is that right?
       A. They were the major shareholder, yes.

  Q. When in 1990 did you buy them out?
       A. I think the actual final transaction was June.

  Q. June 1990?
       A. Yes.

  Q. When did McKey start selling to supermarkets?
       A. 1990.

  Q. Was that after you bought McDonald's out?
       A. Yes, because then I had the authority to do it.

  Q. So prior to that McKeys only supplied McDonald's?
       A. No. Prior to that McKey supplied McDonald's, and in
part of their history they supplied the American Air Force,
the PX Stores on the bases, the Ministry of Defence and the
       Admiralty.

  Q. But you did not supply any retail outlet?
       A. No, not before 1990.

MR. JUSTICE BELL: Can you keep your voice up and if you speak
out across the court? When Ms. Steel is asking a witness a
question, since they are nearer to each other than anyone
else, it can easily subside into a conversation.
       A. I am sorry.
