Day 090 - 16 Feb 95 - Page 02

                                Thursday, 16th February, 1995.

MR. RAMPTON: My Lord, I would like, if I may, before the
Defendants cross-examine Dr. Pattison to deal with the
documents your Lordship was asking about yesterday.

  MR. JUSTICE BELL: Yes.

MR. RAMPTON: May I do that? These documents the Defendants
have now been given. There are three separate bundles of
documents. I will, if I may -- Mrs. Brinley-Codd has put
her post-it on to tell your Lordship where they should go
in the bundles -- tell your Lordship what they are.

We have made enquiries of McDonald's in this country
overnight and Dr. Pattison has made enquiries of Sun Valley
in Hereford, and also of Cargill Foods in France. These
documents emerge as a result of those enquiries. The first
document, the first bundle, contains the following. There
is no summary available that can be found for the month of
January 1994. I am talking now about McDonald's documents
which is the first clip. What we have, therefore, done is
to dig out the summary for each week of January 1994 which
is the first four sheets in the first clip. The fifth and
last sheet in that clip is the monthly summary for August
1994. When I say "summary", I mean summary of
microbiological counts as determined by laboratory
       analysis.

My Lord, the next clip comes from France. If anybody needs
it, I can provide assistance with the meaning of the French
if at any stage it should be needed. What these documents
represent are the full range of the results of quality
assurance checks done by the plant in France for one day.

The French plant does not kill chickens. It does not
debone them. What it does is to make McNuggets and chicken
sandwiches out of meat supplied by approved suppliers from
various parts of Europe, including France, this country and
Holland. It makes the McNuggets and the sandwiches and
then sends them back to this country.

MR. JUSTICE BELL: Right. So bundle 1, they came from
       McDonald's possession?

MR. RAMPTON: They came from McDonald's, my Lord, yes.

MR. JUSTICE BELL: And these come from Sun Valley's possession?

MR. RAMPTON: These are Sun Valley or Cargill documents,
strictly, but Sun Valley is a subsidiary to Cargill.

MR. JUSTICE BELL: I will keep calling them "Sun Valley" for the
       moment.

MR. RAMPTON: My Lord, they represent the full range of tests
for one day quality control tests for both McNuggets and
for chicken sandwich. They include, as your Lordship will
see in due course, microbiological results, matters of that
kind, temperature and so on. The first sheet,
