Day 095 - 02 Mar 95 - Page 02

MR. MORRIS: Just very briefly, I was asked really to check out
with the USDA what the actual directives for inspectors
were. I got the fax last night from the director's office
of the Poultry Food Safety and Inspection Service which has
the directive in it which I have given to the witness and
to the Plaintiffs. It does speak for itself. I could
probably deal with it in about three or four minutes, if I
just ask the witness a couple of questions.
MR. JUSTICE BELL: Have you had time to read it through?
THE WITNESS: No, I have not. It was just handed to me about a
       minute ago.
MR. JUSTICE BELL: Why do you not come back to it at 2 o'clock?
MR. MORRIS: OK. (To the witness): Have you seen it before?
       A. I have not seen it so I cannot tell you.
MR. JUSTICE BELL: As it is a little compartment in itself, deal
       with it at 2 o'clock.
  MR. MORRIS: OK.
MS. STEEL (To the witness): Have you a copy of your statement
       to hand?
       A. Which one?
  Q. The third statement.
       A. Can you direct me to it, where to find it, please?
  Q. The yellow volume, Rearing and Slaughter.
MR. JUSTICE BELL: Yellow IX, please, divider 4.
MS. STEEL: You have got that statement there, the third
statement? It should be at tab 4.
MR. JUSTICE BELL: I have referred him to the third statement.
MS. STEEL: At the bottom of that statement at the bottom of
first page of that statement -- sorry, it says in that
statement: "It is not a part of McDonald's product
specifications that cattle used to supply beef" -----
MR. JUSTICE BELL: Where are you?
MS. STEEL: In the second paragraph, the second sentence: "It
is not a part of McDonald's product specifications that
cattle used to supply beef to us be free from growth
promoters or antibiotics. In the USA both growth promoters
and antibiotics are given to cattle". That is correct, is
       it?
       A. It is correct. I am having difficulty in finding that
statement, but it is a correct statement.
MR. MORRIS: It is actually called the Second Supplementary
       Statement.
MR. JUSTICE BELL: It is divider 4, the first page, the second
