Day 109 - 28 Mar 95 - Page 04

seems to me it was probably turned up to 80 so that he
could see whatever he wanted to see.

MS. STEEL: I think Dr. Pattison did actually say they could be
turned up. I do not know whether he said to what level.

MR. JUSTICE BELL: We have not heard anything about whether they
were turned up or not one way or the other when the walks
       were done, that I recall.

MS. STEEL (To the witness): You mentioned about individual
birds yesterday and that being in the Codes of Practice?
       A. Yes.

MR. JUSTICE BELL: It was in the regulations.

MS. STEEL: Yes. I just happened to find this last night
actually in Dr. Gregory's bundle, orange -----

MR. JUSTICE BELL: Volume V of the orange ones, it maybe the
       last one?
       A. It is missing actually.

  Q. They may be out of order.

MS. STEEL: If you turn to tab G on page 303?
       A. Yes.

  Q. Perhaps you could read out the last paragraph, paragraph
       40?
       A. "Frequent inspection of the stock is essential because
the condition and reactions of the birds are the main
guides to their welfare. An inspection must be made at
least once daily in addition to the looking-over which
birds receive during routine management work ... injured or
dead birds should be removed promptly, as should individual
       sick birds".

  Q. Is that the part you were referring to yesterday?
       A. No.

MR. JUSTICE BELL: No, she was referring to regulations, but I
       have read the regulations.

MS. STEEL: I think you also mention the codes as well?
       A. No, I was not. I was referring, I think, to the
beginning of the Codes where they say that nobody should
set up a new -- nobody should extend or set up a new
       unit -----

MR. JUSTICE BELL: You specifically referred to the regulations
yesterday and at the moment I agreed with you, it looks as
if they refer to individual animals rather than livestock
       generally, having read the regulations.
       A. Yes, I -----

MS. STEEL: I do not know whether it matters, I just happened to
       notice it last night -----

MR. JUSTICE BELL: You cannot do better than regulations.
