     1        called.  I am assuming that some enquiries were made in the
     2        intervening time of people who actually knew what was or
     3        was not happening in Jarretts, yet it was decided to call
     4        Mr. Bennett rather than someone there.

     6        The status of the documents is still up in the air, as far
     7        as I am concerned.  I have not made a decision in relation
     8        to that.  I really certainly do not see why a decision
     9        should not be made fairly quickly as to whether, firstly,
    10        there are further things to be put to Ms. Hovi which is how
    11        this has arisen and, secondly, whether you wish to call
    12        evidence in rebuttal.

    14   MR. RAMPTON:  My Lord, as soon as we can.  We will certainly do
    15        it within six weeks and I hope before then.

    17   MR. JUSTICE BELL:  What I will say, I would like you to tell me
    18         -- if someone can make a note of this -- at the end of
    19        that first half week of next term, which is the week
    20        Mr. Nicholson is being called, whether more time is
    21        required to decide whether you want Ms. Hovi to come back.
    22        If the decision has been made one way or the other, then
    23        she might just as well know.  If you do need more time up
    24        to a maximum of six weeks, then I would like you to mention
    25        it then.

    27   MR. RAMPTON:  I will mention it one way or the other at the end
    28        of that week.

    30   MR. JUSTICE BELL:  Yes.  You have made a note of the date,
    31        Mr. Morris?

    33   MR. MORRIS:  Yes.  The next thing we want to bring up before our
    34        witness is called is we contacted Mr. Andrew Tyler.  Partly
    35        through my own fault, I had not confirmed with him his
    36        appearance on Wednesday.  He cannot make it.  But after
    37        further discussion he agreed to defer his whole evidence on
    38        pigs in any event to Dr. Long who is being called today.
    39        So, effectively, his evidence is cancelled on pigs.

    41   MR. JUSTICE BELL:  You need not give any further explanation; so
    42        the end result is you do not propose to call Mr. Tyler?

    44   MR. MORRIS:  No.  We may call him on the interview he had with
    45        Mr. Preston but that can be left until later.  That is a
    46        very simple matter.

    48   MR. JUSTICE BELL:  Yes, very well.  If that is so, is there any
    49        possibility of calling, is it, Mr. Bruton on Wednesday
    50        rather than the Thursday?  What I would like you to do is 
    51        as soon as possible and if you cannot manage it earlier 
    52        when you leave court this afternoon, see if you can contact 
    53        Mr. Bruton and see if he could come on the Wednesday.  This
    54        is subject to seeing how we get on with Dr. Long today.
