and the operational team supervising that restaurant will
decide who has earned that particular award. They get one
       award of £250 per year.

  Q. Your paragraph 17 of your statement says, I think, £150?
       A. That is a typing error; that should be £250. It always
       has been £250.

MR. MORRIS: Sorry, what paragraph was that?

  MR. JUSTICE BELL: 17.

MR. RAMPTON: The relevant page in tab 3 is 143, my Lord. (To
       the witness): What about scholarships?
       A. Yes, we provide, I believe it is, 12 scholarships a
year, and it used to be second and third year students, of
       £1,000 per year.

  Q. I think, in fact, one looks at page 274 of tab 5 in this
volume, one sees that by 1992 they go done from £1,000 to
       £750?
       A. Yes, the reason for that was we included the first
year, so it is paid three times rather than twice.

  Q. So it is a smaller amount for a longer period.
       A. Yes, it is a greater amount all told.

  Q. Can I come to the actual rates of pay themselves? Can
I start, first of all, with what one might call the rates
for different shifts? Could you, please, turn back to page
118 in this tab which, I hope, is a section headed "Pay"?
       A. Yes.

  Q. It says: "Your hourly rate of pay will depend on the times
you are required to work. Three rates of pay are
applicable. Regular rate applies when working between
7 a.m. and 7 p.m. Evening rate applies when working
between 7 p.m. and 11 p.m.. Premium rate applies when
working between 11 p.m. and 7 a.m." Mr. Nicholson, do all
the stores work between 11.00 at night and 7.00 in the
       morning?
       A. They will work for some hours between 11.00 at night
and 7.00 in the morning. They do not all have permanent
staff on 24 hours. Some of the smaller stores will.

  Q. It was a poor question, what I meant was are they
       all -----

MR. JUSTICE BELL: Do you mean after 11.00 or before 7.00,
       really?

MR. RAMPTON: Yes. I was wondering to what extent the stores
are open to serve the public between those hours?
       A. I would say the majority of stores still close at
11 p.m. but then you have closing work to do. A number of
       stores, however, stop open.

  Q. There is a chap called the Night Closer who gets a bit more
than other people do; is that right?
       A. Yes, if they have a Night Closer then they do not have
