Day 118 - 01 May 95 - Page 05

MR. JUSTICE BELL: What I suggest is, do not refer to those
       documents today.

  MR. MORRIS: Yes.

MR. JUSTICE BELL: We can pick it up in the morning, if need
be. Mr. Rampton or Mrs. Brinley-Codd can talk to
Mr. Nicholson about them overnight. Mr. Nicholson, if he
has not yet seen them, can look at them overnight. We will
see whether they are matters which, having looked at, he
can deal with of his own knowledge or whether he has to
       make some further enquiry.

MR. MORRIS: If I can just say that I think Mr. Rampton's
speech, if you can call it that, was basically directed at
times when we do find cross-examination confusing and
difficult, which is inevitable in a case of this complexity
and length and especially when there is a new issue. There
is an enormous mass of documents and an enormous breadth of
issues within this issue. We would hope that the court
would be understanding that it is not always easy to -----

MR. JUSTICE BELL: I do not even know what is in there, so I am
not going to make any further comment about it. What I ask
you to do now, and Ms. Steel, is start your
cross-examination of Mr. Nicholson, and steer clear of
anything which requires reference to any of these documents
until further notice. If need be, we can pick it up in the
morning when I have had a chance to look at it and
Mr. Rampton has had a further chance to look at at it and
Mr. Nicholson has had a chance to look at the documents as
       well.

MS. STEEL: I wanted to say something else as well. Last night
my computer conked out. I have got various notes on there
about where cross-referencing and things like that, so
I may have a problem with cross-references. I did not have
       questions on there.

MR. JUSTICE BELL: Is that this one or your own one?

MS. STEEL: My own one at home. It just may create problems
with cross-referencing because that is where all my notes
       are.

MR. JUSTICE BELL: Have you got someone to look at it?

MS. STEEL: I have had to be here.

MR. JUSTICE BELL: When you say "conked out", what do you mean?

MS. STEEL: It does not start up. It is not working at all.
The screen is working but not the computer, because they
       are separate power sources.

MR. JUSTICE BELL: Who do you propose to go to help you with
it? It may be something comparatively simple.

MS. STEEL: I was going to try to sort something out after
court today. Obviously I could not do anything yesterday
