Day 145 - 29 Jun 95 - Page 04

  MS. STEEL:   I think it is about 20 minutes, but I am not sure;
it might be less than that.

MR. JUSTICE BELL: Mr. Stein, if you come and sit on the front
       bench.

                  (The video recording was shown)

MS. STEEL: If you could stop the tape?

MR. JUSTICE BELL: That is all of the tape you want to show?

MS. STEEL: Yes. That is the video that is used to train all
management, is it not, is that correct?
       A. First of all, I am not sure how old that video is.

  Q. 1989, I think it is dated.
       A. OK. I would imagine there have probably been two,
three or four new ones since then, so that would have
       existed back in 1989.

  Q. That was correct in 1989?
       A. I guess so; I have not seen that specifically.

  Q. If that is the date on the video that would be the date it
       was shown?
       A. I am not disputing it. If you are saying it is our
       tape, it is our tape.

  Q. Did you notice at the beginning of the clip that we showed
it actually said: "Fast service means every customer
served as quickly as possible, faster than the minimum
service standard of two minutes in line and one minute at
       the counter"?
       A. Yes, I saw "fast" relating to how long we want people
       waiting and all that, sure.

  Q. So has the Company cut that extract about running ---
       A. Cut that extract about running?

  Q. -- or is that still in the training videos?
       A. I think it was very obvious what the film showed. You
can use the term "running" any way you would like. It was
obvious to me that there was no racing up and down. People
were moving with dispatch and quickly, but I did not see
what you are attempting to describe to me.

MR. JUSTICE BELL: Where the voice-over said: "If you run your
crew will run", we saw the Manager moving quickly but not,
in fact, running by my terminology?
       A. The same with me, my Lord.

  Q. However that may be, what is being put to you if you
actually use the word "run" people might be encouraged to
run in anyone's terminology. That is what is being put to
       you.
       A. If you will, my Lord, in American-ese, when I think of
managing a shift -- in fact, I probably used it here --
I will say "running a shift". "Running" can mean physical
