Day 174 - 17 Oct 95 - Page 05

most prominent in terms of organising things?
       A. Certainly, as it went on, he was perhaps more
prominent, but he was no more prominent than anybody else
       initially.

  Q. Actually, for the injunction which we referred to just now,
those affidavits, he was named as the First Defendant.
Would that be significant, that the first one would seem to
       be the most prominent?
       A. I could not say. It depends on what way the solicitor
       drafted it.

  Q. I do not know. Anyway, do you recall any dispute between
him and union officials where he had criticised union
       officials?
       A. Well, from memory, he seemed to have a bit of a dispute
with them, because when I met with Mr. Michael Mullen he
indicated that they were having difficulty with him and
       that -----

  Q. He had criticised them, basically, for not doing enough to
support the dispute, something like that?
       A. He certainly was having a difference of opinion with
       them, that is for sure.

  Q. OK. Just to side track a minute, because it is in your
statement -- can I just ask the court: the new documents
that were served by Defendants, I do not know if the
witness box has the same file?

MR. JUSTICE BELL: They are 59A.

MR. MORRIS: No, the Defendants' ones from about three weeks
ago, the ones that had all the different subjects and
       issues in them.

MR. JUSTICE BELL: Number 7, supplementary 7?

MR. MORRIS: Yes. If the witness could be referred to it --
I do not know where they would be kept.

MR. JUSTICE BELL: Do you want Mr. Mehigan to look at it?

MR. MORRIS: Yes. I do not know where it would be kept.

MR. JUSTICE BELL: Probably right at the right-hand end in the
bottom shelf. Is there a number 7? Yes, take that,
       please, Mr. Mehigan.

MR. MORRIS: Yes. It is in the employment documents.

  MR. JUSTICE BELL: Divider 6.

MR. MORRIS: It should be the document that is -- maybe you
could help me, my Lord. I am not sure what number it is.

MR. JUSTICE BELL: Which one is it?

MR. MORRIS: There are about four stapled together -- press
       cuttings from Ireland.
