Day 194 - 01 Dec 95 - Page 06

manager was, who we did actually ask Mr. Sexton about,
a woman called Angela, who was a Jehova's Witness. That is
the only person where any names are going to come up.

MR. RAMPTON: In fact, I think your Lordship's first ruling is
early on the 18th. That was in relation to Mr. Whittle,
where your Lordship had something to say. No, it was the
18th; it was 18th October. There is an actual ruling.
What your Lordship said was this, and this is ------

MR. JUSTICE BELL: Let me find it.

  MR. RAMPTON: I am sorry.

MR. MORRIS: I have something about a ruling on 28th October, as
       well.

MR. JUSTICE BELL: Yes, Mr. Rampton.

MR. RAMPTON: The material passages, first of all, are at
page 10, just below letter B.

MR. JUSTICE BELL: At 5B, I explained the difficulties.

  MR. RAMPTON: Yes.

MR. MORRIS: What are we looking at now?

MR. JUSTICE BELL: It is a ruling on 18th October, 1995.

MR. RAMPTON: My Lord, at 5B to F, your Lordship explains the
reason. 10B to D, again. The actual ruling is on page 11,
top of the paragraph beginning at C, down to E.

MS. STEEL: If I could make a fundamental point? I do actually
specifically remember bringing this up at the time, but
I cannot, unfortunately, remember what day it was; I will
look it up after this. But if I could just point out that
on page 5 the reason given for not allowing anything that
there was not any notice of was that Mr. Rampton might have
to ask for leave to call evidence in rebuttal. That is at
       5F.

Now, exactly what we are doing here is calling evidence in
rebuttal of what the Plaintiffs' witnesses said when they
were in the witness box. Therefore, the Plaintiffs are not
going to need to call anything to rebut it. They have
already said their piece. We must be entitled to rebut
what they have said, where our witnesses disagree with it.

MR. JUSTICE BELL: Does anyone want to say anything further?

MS. STEEL: I do not really have anything further to say, apart
from just saying that I am sure I did raise this, and it
was recognised that it was our entitlement to rebut what
the Plaintiffs' witnesses have said when they were giving
       evidence.

MR. JUSTICE BELL: I propose to give leave to Mr. Morris to ask
Mr. Sutcliffe to give any further evidence which he wishes,
