Day 200 - 12 Dec 95 - Page 05

MR. JUSTICE BELL: What did you say then? You can see two birds
       to the right.

THE WITNESS: There are three birds. You can see one on its
side, one in the middle of that that is on its side, and
then this little one virtually right in the middle. If you
have a look, there are three birds up and then it is
virtually in the middle to the right, the one with black
feathering, there are three birds in that particular ----

  MR. MORRIS: Underneath.

THE WITNESS: Yes, there are two underneath.

MR. JUSTICE BELL: There are three disabled birds there, are
       there?

  THE WITNESS: Yes.

MR. JUSTICE BELL: I can see that.

THE WITNESS: This is a different bird. This one cannot stand.
There are two here. There is one underneath the hopper
that is dying, and there is a little crippled bird there
trying to get to the water. This is a different bird again
       with its leg sticking up.

MR. JUSTICE BELL: Is that the same or a different one?

THE WITNESS: That is a different one to the other three. Just
above the screen where it is a little bit crackly, there is
a bird under the yellow hopper that cannot get up. There
is also one to the right as well. This is a different bird
       again.

MR. RAMPTON: My Lord, may I intervene to say, I do not know,
perhaps it would be helpful if Miss Watkins could tell us
when we start the actual film?

MS. STEEL: It starts, I have a note of -- it goes for a little
       bit.

MR. JUSTICE BELL: Are these different birds?

  THE WITNESS: Yes.

MR. JUSTICE BELL: Can you stop because you said on several
shots that it was a different bird and then changed shots a
number of times, and you did not say it was a different
bird. So, am I to assume that each change of shot is a
       different bird?

THE WITNESS: Most of the time, apart from there is one that is
of the same bird, but we have not come to that yet. Do you
       want me to rewind?

MR. JUSTICE BELL: Can you go back to the one which was walking
but with difficulty across the environment/index.html">litter?

THE WITNESS: This is a different bird. Now, in this particular
