Day 250 - 15 May 96 - Page 04

MR. MORRIS: Just in case we refer to anything.

MS. STEEL: I am not intending to at this stage.

  MR. JUSTICE BELL: No. Yes?

MS. STEEL: If we could get out the counterclaim bundle, I will
       just check, No. 2.

MR. JUSTICE BELL: Which do you want?

MS. STEEL: Bundle No. 2, counterclaim 2. The one with the
       pink and white label?
       A. Yes.

  Q. Incidentally, while we have the counterclaim bundles out,
I have a note of various pages which are blanked out, parts
blanked out, and whole pages which are blanked out which go
through the publication and counterclaim bundles, and I am
sure I know what the response is going to be but we want to
formally apply just so that is all covered.

MR. JUSTICE BELL: You are not to be deterred from implying by
any previous decision, because I have to approach each
       application on its own merits.

  MS. STEEL: Well, the...

MR. JUSTICE BELL: It may be the same decision, it may be not.
I think what you have to do, if you want to do a number of
them together, is make a list of them in advance and then
I will look at them overnight some time, because I will
have to refamiliarise myself with the documents in
       question.

  MS. STEEL: OK.

MR. JUSTICE BELL: Tell me what it is which you say should lead
me to suppose there is something relevant there, or what it
is you say which means that the blanking out makes it
difficult to understand the parts which are left in.

  MS. STEEL: Right.

MR. RAMPTON: My Lord, I too, may I say this, would need notice
because I did not do these bundles myself, Mr. Atkinson
did. Obviously, he would have to respond.

MR. JUSTICE BELL: He is not, very sensibly, always here.

MR. RAMPTON: No, no. So I would have to refer to him to find
out in relation to any particular document what the reason
       was.

  MR. JUSTICE BELL: Yes.

MS. STEEL: OK. I will do that at some stage. If we could
turn to tab 89 there is a fax that has been sent to you?
       A. Yes.
