3 MR. MORRIS: We have just served a new witness statement
4 regarding the situation in New Zealand and trade unions.

6 MR. JUSTICE BELL: In what?

8 MR. MORRIS: Regarding New Zealand and trade unions which I was
9 going to bring up today anyway. It is from the Industrial
10 Organiser of the Service Workers Union regarding their
11 agreements with McDonald's in New Zealand.

13 MR. RAMPTON: My Lord, I think I should be entitled to object to
14 this for a number of reasons; I am not going to do so. I
15 have glanced at the document. I am just looking to see if
16 there is anything about New Zealand in the abstract.
17 I cannot see anything at the moment. I could easily be
18 mistaken because I have only skimmed through it.

20 Plainly, we are not in a position -- have not been put in a
21 position -- where we can deal with anything that is in that
22 document. I have not had a chance to speak to Mr. Stein
23 about it, and plainly at the moment we have no evidence
24 from New Zealand for the reason, of course, that this takes
25 us by surprise. My Lord, on that basis, having said that,
26 I do not formally object to this, but I do ask that no
27 questions should be asked about it until I have had a
28 sufficient opportunity to take instructions.

30 MR. JUSTICE BELL: Let me just read the letter.

32 MR. MORRIS: It is a statement to us for the purposes of this
33 case done last night.

35 MR. JUSTICE BELL: How long did you anticipate your
36 cross-examination of Mr. Stein is likely to continue?

38 MR. MORRIS: We think we may finish on Thursday.

40 MR. JUSTICE BELL: Do not deal with New Zealand before
41 tomorrow. If Mr. Rampton wants to address me further about
42 this in the morning he can. But, as far as I am concerned,
43 he, Mr. Atkinson, or Mrs. Brinley-Codd or anyone from her
44 firm whom Mrs. Brinley-Codd chooses, can ask Mr. Stein
45 anything they wish about the letter. Let us leave it there
46 for the moment. If anyone wants to say anything more about
47 it, they can do so.

49 For the time being I will add it to your Civil Evidence Act

52 MR. MORRIS: Yes. The article which is referred to in the
53 documents was in our extra list of employment documents
54 served about six weeks, couple of months, ago. I cannot
55 remember what number it was but it is an article on labour
56 notes.

58 MR. JUSTICE BELL: One thing I will say: Mr. Rampton has taken
59 no objection to this, so there we are. It is not to be
60 assumed on either side that parties can serve witness
