                                                                  DAY 212

                                                   KIM MOFFATT, Examined:

strict management style and made it clear to everyone what
was expected from them. It seemed to me that he was sent in
as a sort of trouble shooter to improve the restaurant.
I considered he was the best Store Manager I have ever
       worked for."
       A. Yes.

  Q. I think you left Heathrow in about August 1994, did you
       not?
       A. Yes.

  Q. Can I ask you what you mean by saying that Dave Roberts was
the best Store Manager you had ever worked for what?
       A. Just he was quite strict, but he was friendly, very
good with people, and he just believed in everything that,
you know, was set when I started work, and he was just, you
       know, quite good presence.

  Q. Then one other thing, paragraph 9, about the accidents or
burns: "Beech is correct in saying that burns do occur.
He is not correct, however, in saying that they were not
recorded in the Accident Book. It was part of my job in
orientating new employees to ensure that they knew where
the Accident Book was kept, and that if an accident
occurred they should fill it in themselves or report it to
a Manager for him to do.

"I also used to monitor the Accident Book myself and
consequently I know that it was being used. In fact, the
restaurant had two or three Accident Books in use at that
       time.

"As you may or may not know, we have only been able to find
one Accident Book, and I expect you have all noticed that
it has a gap in its entries between 16th March 1994 and
23rd October 1994". First, have you any idea why that
Accident Book has got that gap?
       A. No, I cannot .....

  Q. Have you any idea what happened to the other Accident Book?
       A. The only thing I can think of is we had two running at
the same time, perhaps just to, you know, an error of
someone setting up two and the other one has been lost. I
mean, we had a fire in the store, but I do not think it
       ties in.

  Q. Do you remember when the fire was?
       A. I cannot recall. It was while John Nevison was the
Store Manager. I can recall that.

  Q. It was while he was Manager?
       A. Yes, yes.

MS. STEEL: Sorry, I am finding it really hard to keep up.

MR. RAMPTON: Sorry. (To the witness): So that would have been
between about February 1994 and the end of June when Dave
       Roberts took over?
       A. Yes. I think it was probably about three weeks into or
a month into John Nevison starting. It was quite soon
