                                                                  DAY 212

                                                   KIM MOFFATT, Examined:

it is, "Defendants' witnesses volume II". If you turn to
divider 31, I hope -- I do not know what order they are in
in that file -- you will find some handwritten notes. They
are not Mr. Beech's handwriting. They are Mr. Morris'
       handwriting.
       A. Yes.

  Q. You have those, have you?
       A. Yes.

  Q. Are they headed, "Notes for further details of Alan Beech's
       evidence"?
       A. Yes.

  Q. What I am going to do is read these out, Miss Moffatt, and
then ask you to comment on them; not all of them, but
some. The first one under "breaks and hours", it says:
       "Alan Beech's shifts were usually 4 p.m. to 11.00 p.m. or
       12.00 p.m., sometimes did 12.00 until 8.00, according to
the schedule. Most people worked past schedule time, not
allowed to go or pressured to stay on for generally
anything from 15 minutes extra to five hours extra. This
happened to others." We do not know whether he means
others than himself or others as well as himself.

Miss Moffatt, do you have any comment on that allegation by
Mr. Beech about his hours and his shifts, so far as your
recollection of his time in the store is concerned?
       A. I thought -- I did not think he did as long. I thought
he did a minimum of about eight, so I do not think he did
-- because he had put 12.00 to 11.00 or 12.00, I do not
think he did as long as that. I cannot -- I know he was
       not pressured into staying on.

  Q. Were you ever there when closes were being done from, sort
       of, 11.00 to midnight?
       A. No.

  Q. No.

MR. JUSTICE BELL: You said a minimum of eight. Did you mean a
       minimum of eight?
       A. I do not think he did much more than eight hours at a
       time.

  Q. Yes. Minimum of eight means not less than eight?
       A. Yes, sorry -- maximum

  Q. You meant maximum?
       A. Yes, sorry.

MR. RAMPTON: Then he says next: "On 4.00 to 12.00 shift, which
is an eight hour shift", but then he puts in brackets
"(i.e. 4.00 to close)", and Mr. Morris has put in square
       brackets "[1.00 to 2.00 p.m.]". I think he must mean 2
       a.m..

MR. MORRIS: Yes, sorry, it is a mistake.

MR. RAMPTON: "... often got given a break" -----
