DAY 212
KIM MOFFATT, Examined:
it is just on the computer; and anything over and above
that will show up.

Q. As an excess?
A. Yes.

Q. For what period of time does the computer count the hours
and the excess hours?
A. Well, it is obviously calculated every evening when you
close down the Hunter, and there is through a fortnight; so
that is actually like a pay period.

Q. So the total which we see on the next week -- we can look
at them if we have to; you are familiar with them and so
are we -- the total which we see on the excess hours sheets
sometimes increases from one day to the next?
A. Yes.

Q. So the period during which that happens is a fortnight?
A. Yes.

Q. In other words, a pay period?
A. Yes.

Q. What is the number of hours for a full-timer over which the
hours are excess?
A. 39.

Q. Did your Heathrow excess hours and zero hour sheets have
the same notification, "F" and "P", for full-time and
part-time?
A. Yes.

MR. MORRIS: I know I can wait until cross-examination, but
I was not sure if that was completely clear about the
fortnight, how it relates to the fortnight; the excess
hours, how they relate to the weekly and hours and the
fortnightly -----

MR. JUSTICE BELL: I suggest you take it up yourself when you
come to it, because Mr. Rampton may ask. It is not clear
to me whether that is just Company policy or something
which is in some statutory provision for some reason.

MR. RAMPTON: I think it was statutory until the beginning of
1990, and then I think it disappeared; and I think
your Lordship has heard evidence that the Company
nevertheless continued doing it.

MR. JUSTICE BELL: I understand that, the after 10 or after
12 ---

MR. RAMPTON: Sorry, that is my fault.

MR. JUSTICE BELL: -- but the 20 hours or 39 hours, because
I thought excess hours -- we had had some reference which
made me think it was a term of art to do with legislation.
I may be completely wrong about that.

MR. RAMPTON: Your Lordship is absolutely right. I got
