                                                                  DAY 212

                                                   KIM MOFFATT, Examined:

confused. No, it is nothing to do with the age, although
the age does appear if it is under 18.

(To the witness) Do you know the answer to that,
       Miss Moffatt?
       A. I did not understand the point.

  Q. Is the reason for keeping excess hour sheets a question of
law, do you know, or is it just Company policy?
       A. I do not. I think it is Company policy, I think.

  Q. Can you tell us -- and do not speculate, but from your own
experience -- if somebody is in a period, or perhaps even
two or three periods, regularly working excess hours
according to the sheets, whether anything is done about it?
       A. Yes.

  Q. What is it that is done about it?
       A. Well, obviously, if we notice whilst I am checking it,
daily, I will probably speak to the Manager that worked
with them. So, if on a Tuesday they work excess hours,
then I will say to the Manager: "Why did", you know,
whatever,"work three or four excess hours?" Also, on a
larger scale, I would speak to the lady that did the
schedule; and also it would be brought up at Managers'
       meetings.

  MS. STEEL: Sorry.

MR. RAMPTON: Sorry. (Pause) Would one then expect to find --
I do not know, you tell us whether this is right -- that
after perhaps a period of a few days when somebody keeps
showing up on the sheets as working excess hours, would one
expect to find that stopping and him or her not appearing
       again after that?
       A. Yes, unless there is a good reason, like they are
full-time instead of part-time and it has not been
       adjusted. But, yes, generally.

  Q. If you can go back now then, please, to the Beech notes at
(B), still on the first page, "pay"; do you see that one?
       A. Yes.

  Q. "B (that is Beech) discovered from looking at the disclosed
documents" -- those are, I think, the payroll summary
sheets -- "that he is owed £59.72 holiday pay. No one ever
told him he was entitled to any holiday pay." Can you
       comment on that or not?
       A. Yes. Everyone is told at the orientation and it is in
the Crew Handbook, and it is one of the subjects I do
cover; it is the first one, holidays; and, also, it is
covered in pay policy; again, I cover it a couple of times
       in the orientation.

  Q. If you can, explain, please, how the entitlement to holiday
       pay arises?
       A. Well, an employee will work for the Company for six
months without holiday pay. Once they have worked for six
months, every fortnight, when the payroll is calculated,
they will get 8.33 per cent holiday pay. It is not taken
