Day 212 - 30 01 96 - Page 28

                                                                  DAY 212

                                                   KIM MOFFATT, Examined:

       A. And he worked the full notice, he would get it, yes.

  Q. He appears to have worked during the course of this
fortnight about 28, 29 hours, something like that.

MR. JUSTICE BELL: I assume the accrued holiday pay, £5.67, is
       8.33 ---
       A. -- per cent of that.

  Q. -- per cent of 68.17. I assume it is -- leading to a total
       of 59.72.

MR. RAMPTON: And the "holiday pay owed" entry would be what has
       accumulated?
       A. Yes.

  Q. At that time?
       A. Yes.

  Q. At that date. It may not help, but just because people are
curious about these things, do you know what the column
"holiday week due" means, where we have got figures with
       decimals?
       A. I just think he is definitely owed a week, and then it
is -- I am not 100 per cent sure, but I know he is owed a
week and a half, just over.

  Q. Can it happen that somebody gives due notice, works out
their fortnight, and then leaves, and they do not get their
       holiday money?
       A. No.

MR. JUSTICE BELL: But what if a student says to a
Manager -- I do not know whether it is Mr. Beech's case or
not, but he does not write any form of notice, but just
says at some time in August or September: "I have got to
       leave towards the end of September to go to college";
I mean, is that notice or not?
       A. Yes, because they have informed us. There is a
       different -----

  Q. So it could be informal in that way?
       A. Yes.

  Q. But if he says the day before: "I am off to college next
week", then that is not good enough?
       A. Yes; and that is a college worker's sort of situation,

MR. RAMPTON: I am going to leave holiday pay now. If anybody
wants to else to ask about it, they are welcome in due
       course.

Can you go now, please, Miss Moffatt, to the second page of
Mr. Morris' handwritten notes? We have dealt with his
working on the grill on his first day, so he says. Then
there is an entry which says: "Clam shells were sometimes
badly set when Mr. Beech came to work." Have you got that
       one?
       A. Yes.
