Day 212 - 30 01 96 - Page 32

                                                                  DAY 212

                                                   KIM MOFFATT, Examined:

       behaviour?
       A. No, nothing.

  Q. Not even during John Nevison's time?
       A. No. I do not really understand "did not play the
game"; I do not understand what that is meant to mean.

  Q. I do not know either, but assume it means people not
wanting to work the hours that the Managers wanted them to
       work.
       A. No, because they -- no, I do not; never have.

  Q. Would you mind putting those Heathrow documents and the
statements away? Fold them up and put them on the table
beside you. I am going to ask you to go into another
file. The file I would like you to get has "Bath" on it,
and it is volume 1 of the Bath file.

MS. STEEL: Could we have it, please? We did not have a court
       set.

  MR. RAMPTON: The Bath one.

MR. JUSTICE BELL: Can you hold on, because I have to find
       mine.

MR. RAMPTON: Sorry, my Lord. (Pause)

MR. JUSTICE BELL: Yes, I have them here.

MR. RAMPTON: (To the witness) Could you turn to section C and
tab 9, and the first page, which is page 159? It is not
your restaurant; it is not Heathrow; it is the Bath
restaurant. There is a document headed "Human Resources
Evaluation Report", and it was apparently done on
       12th October 1993.

My first question is: have you have ever done any of these
       exercises yourself?
       A. Yes.

  Q. Where?
       A. Staines, Heathrow, and my present store.

  Q. Farnborough?
       A. Yes.

  Q. And you have done them in your capacity, therefore, as
       administration assistant?
       A. Yes.

  Q. We notice that this one says it was done by, I think, a
girl called Rianna Easton, who is described as a Floor
Manager. In what circumstances would a Floor Manager do or
be asked to do a Human Resources Evaluation Report?
       A. If Human Resources personnel is her goal; so, if the
Manager set -- they set different goals in different areas
of the stores. So, obviously, it looks like it is her
goal, so she is doing audits, or she has been asked by the
       Store Manager to do it.
