DAY 212
KIM MOFFATT, Examined:
Q. Yes.

MR. RAMPTON: Then, please, turn on to page 169, which is -- it
is in the same audit report -- a sheet headed "Breaks
checklist"; yes?
A. Yes.

Q. Have you seen one of these sheets before?
A. I have seen it, yes.

Q. Have you ever used it?
A. No.

Q. No. Then I will not ask you about it. Finally, just have
a look, please, at page 187 which is the one for
6th October 1994, a year later. Again, under "hours of
work regulations" and please look, first of all, at
"Schedules". It includes the same wording, except that
some of the words have been taken out of brackets, "to
include Sundays work breaks due and total hours for all
hourly paid employees including Floor Managers".
A. Yes.

Q. Can you remember when you first started checking these
things for the Floor Managers?
A. No, I cannot, no.

Q. You will see, if you look at the column on the right-hand
side, on this occasion Bath scored nought out of 40. I am
not asking you to speculate what the reasons were for that
nil score. Have you done these things and scored people
nought out of 40 or 50?
A. Not nought; probably five or 10, yes.

Q. Then if you look at "Breaks taken", on this occasion they
get 35 out of 40. For what sort of thing would you deduct
five marks on breaks?
A. Perhaps someone taking less break than they should have
done or, perhaps, taking too long; a bit of both, really.

Q. Taking too long?
A. Yes.

Q. If you turn over, finally, Miss Moffatt -- it is the last
thing I am going to ask you to look at -- to page 188,
there is a list of names on the left-hand side on this
occasion 18 names. Have you ever done as many as 18?
A. No.

Q. Do you use a chart similar to this yourself?
A. Yes.

Q. With the same sort of headings?
A. Yes.

Q. Application form, payroll instruction, interview notes,
employee records, orientation checklist, uniform,
engagement letter, date started, PR numbered down, Crew
Handbook. What does the entry -- others, I think we can
all understand what they mean -- "Crew Handbook" actually
