                                                                  DAY 212

                                             KIM MOFFATT, Cross-examined:

when I told him that it had happened, he would take it up
with the Shift Manager concerned. He would try to schedule
them to work only up to 11.45", et cetera. So he took it
       very seriously, did he?
       A. Yes.

  Q. But it continued to happen for 15 months while he was a
Store Manager and you were there?
       A. Yes.

  Q. Then we had John Nevison arrive for something like a period
of four or five months; yes?
       A. I am not sure if that is right.

  Q. Well, it has been said that he came round about
       February 1994, and left ---

MR. JUSTICE BELL: About four months.

MR. MORRIS: -- left in June.

MR. JUSTICE BELL: Mr. Roberts came in June.

MR. MORRIS: So, Mark Riley was there for 15 months, or
something. Was he there well before you arrived as well?
       A. No. He was there before, but I think he was there for
       about two or three months.

  Q. So he was there for some time in the spring of 1992 to
something like February 1994, about two years, something
       like that?
       A. Yes.

  Q. What disciplinary action did Mike Riley take against anyone
who scheduled someone past 12 o'clock who was under 18?
       A. No one was scheduled past 12 o'clock.

  Q. What disciplinary action did Mark Riley take against anyone
for allowing anybody to work after 12 o'clock who was
       under 18?
       A. I am not sure.

  Q. You are not sure?
       A. No.

  Q. Are you aware of any disciplinary action he took against
       anybody?
       A. Disciplinary as in verbal, he might have spoken at
       Managers meetings.

  Q. He might have done. Did he or did he not?
       A. Yes, he did.

  Q. And people ignored him and carried on doing it?
       A. Not ignored him, no.

  Q. They waited until he was out of the way and did it when he
       was not looking?
       A. I am not sure, because I was not there; I did not
close, so I was not sure.
