                                                                  DAY 212

                                             KIM MOFFATT, Cross-examined:

  Q. But you said it continued happening. Did he have no
control over his store, then, the Manager, Mark Riley?
       A. Yes, he did.

  Q. How come, then, that he was taking it very seriously and
yet it continued for all that time?
       A. Because he had other Managers around him; so he would
take it seriously, pass it on to the Managers; and I cannot
comment on the other Managers. But he did take it
       seriously, himself.

  Q. So the problem, really, was with the management team at
that store; they did not take any notice of what the Store
       Manager was telling them?
       A. I am sure they took notice, yes, but they were under
       pressure.

  Q. But the thing that the Store Manager did not want to happen
was still happening because of the other Managers?
       A. No. He had relay that, obviously, you know, people are
not meant to work past midnight; he would make sure the
schedule was highlighted to the fact. Obviously, I do not
close, so I do not know what went on. But, yes, it did
happen while Mark Riley was there.

  Q. The management team, was that the same roughly under
       John Nevison?
       A. No, there were a few changes, but I cannot remember
exactly because it was quite a long time ago.

  Q. You were only there for four months. So did the whole
management team suddenly change when he came in, or was it
roughly the same people that carried on working, with maybe
       one or two changes?
       A. Maybe, yes; maybe one or two changes.

  Q. You then say the reason why this working after midnight,
under 18-year-olds, problem happened, in your paragraph 4,
you say it was because the store was understaffed, yes?
You say that in your next sentence, do you not?
       A. Yes.

  Q. Mark Riley had failed to deal with the problem of
       understaffing; is that correct?
       A. No.

  Q. When he handed the store over to John Nevison -- you said
the reason those things were happening was that the store
       was understaffed?
       A. Yes, but I did not say that Mark Riley was not doing
       anything about it.

  Q. Well, you say when Mark Riley left, he was replaced by
       John Nevison?
       A. Yes.

  Q. And they were only about 50 to 60 hourly paid staff on the
       payroll?
       A. Yes. Quite a few left when Mark left.
