                                                                  DAY 212

                                             KIM MOFFATT, Cross-examined:

  Q. He was not sacked, was he?
       A. No, no. He got transferred over to Feltham, another
       restaurant.

  Q. As a Manager?
       A. Yes.

  Q. Mark Riley, did he ever get disciplinary action for his
understaffing or for working people past -----
       A. I am not sure. I do not deal with that sort of thing.

  Q. He was promoted to Supervisor, was he?
       A. General Manager and Supervisor, yes.

  Q. The altering of clock cards, you noticed it, you actually
saw clock cards being adjusted, did you?
       A. No.

  Q. I thought you checked the clock cards?
       A. Yes, I did, but when you check clock cards you check a
printout from the machine; you do not actually check anyone
clocking people in and out. That happens -- they do that
       themselves.

  Q. Yes. But you notice which ones have been adjusted; is that
       correct?
       A. No.

  Q. Why do you not know which ones have been adjusted?
       A. Because I used to check -- when you check the clock
cards on an administration level, you merely check that
people have clocked in, clocked out for a break, clocked
back in for a break and clocked out to go home.

  Q. You say you cannot tell which ones have been adjusted?
       A. Yes; they have an asterisk by them.

  Q. That is right. So, you said you were aware that it was
happening and suspect it went on quite a lot. Is that
because of the asterisks on the clock cards?
       A. No. That is because I was slightly aware of the fact
-- because I did not do closes, it is quite difficult for
me to comment. But, obviously, working as an
administrator, you hear that people are working past
midnight; and, obviously, they were not clocked in. So one
just assumes that it is happening. I just assumed it was
happening, because I am obviously not stupid; so, I just
felt that it probably was going on. I never witnessed it,
       myself.

  Q. Did you not see the adjustment audit reports, which are
companion documents to the clock card files?
       A. Yes, I did.

  Q. You did?
       A. Yes.

  Q. So you would be aware of adjustments being made?
       A. It would be adjustments -- yes, they would clock
