Day 212 - 30 01 96 - Page 44

                                                                  DAY 212

                                             KIM MOFFATT, Cross-examined:

someone in and they would clock someone out, and that is
what I checked, that someone has clocked in and clocked
out; so perhaps I might have highlighted it, they may not
have had a break. But if it was less than four hours, they
do not clock in and out for their break, so I would not
have -- I would have just queried it for that.

MR. JUSTICE BELL: When you say altering of clock cards, you
mean the actual file which is printed out by the computer,
do you, rather than a card which is put in itself?
       A. It is done on the computer, just using the card
number. So, say my number was 6 and someone wanted to
adjust mine, they would go in and just number 6 on the
       computer.

  Q. But it is not actually happening on a clock card itself
which is put into a machine?
       A. No.

  Q. Because all the clock card is, under this system -- not
like the clock cards in the old days where you actually
stamped the time on your card or punched a hole in a
       certain part of it ---
       A. No, it is not like that.

  Q. -- all the clock card is doing is sending the message?
       A. Yes.

  Q. -- which puts the time on to the computer?
       A. Yes.

MR. MORRIS: So the altering of clock cards for the
       under-18s -----

MR. JUSTICE BELL: Can we call them clock card files, because
clock cards are not altered. It took me a long to time to
realise that when people say the clock cards are altered,
they do not mean that the clock cards are altered.

MR. MORRIS: Altering of the clock card file, from time to time
you would note that someone who may have been clocked out
officially at, say, 12.39, who was under 18, had been
       shunted back to 11.39?
       A. No, I have never seen that.

  Q. So, is it the fact, then, that other Managers would say,
"That is the practice that we are doing, that if someone
       works past 12, then-----"
       A. They would never say that to me because, obviously,
I would have to go back and tell my Store Manager that, you
know, someone worked past midnight on that day. I am just
saying that I knew that it went on; I was aware of it, but
only as a second -- you know, because obviously I hear
       people talking.

  Q. Other Managers?
       A. No, mainly crew members saying that they worked past,
you know -- it is just, I did not really experience it
       firsthand.
