                                                                  DAY 212

                                             KIM MOFFATT, Cross-examined:

  Q. You did not. So you collaborated with this fraud, did you?
       A. I would not put it in those words, no. I do not really
       understand what you mean.

  Q. Well, you were the person at the store in charge of
       checking the paperwork?
       A. I was in charge of clocking in -- making sure people
clock in and clock out for the day; and if that was done,
then that is OK. That is what I was in charge of on that
       side.

  Q. And to check -- you said that you were checking that people
got their proper breaks, and all that kind of stuff, you
       said earlier on?
       A. 45 minute breaks, yes.

  Q. To ensure that everybody got their entitlement?
       A. Yes.

  Q. And that things were done properly?
       A. Yes.

  Q. And yet you allowed this practice to go on, which you say
that you suspected went on quite a lot.

MR. JUSTICE BELL: Is there any point in attacking Miss Moffatt
over this? If she will excuse me saying so, you have
bigger fish to fry; and she has at least been candid enough
to come into the witness box and say it went on. What is
the point in attacking her about it?

MR. MORRIS: (To the witness) You have come to court, have you
       not, Miss Moffatt ---
       A. Yes.

  Q. -- to try to get the store off the hook by criticising one
individual, John Nevison, when in fact it was the whole
       management team that was -----

MR. JUSTICE BELL: That is not how I read her statement. She
said it happened under Mark Riley, it happened under
Nevison, who was far too kind and was not enough of a
disciplinarian, and even under Dave Roberts -- although he
put paid to it -- it went on for a bit until he managed to
straighten out the staffing. (To the witness) That is
       your evidence, is it?
       A. I just came to tell the truth.

MS. STEEL: You said that eventually you felt you had to mention
about under-18s working past midnight to Semir Khazna,
although you were reluctant to do that, to go above your
Store Manager's head and get John Nevison into trouble?
       A. Whereabouts, sorry?

  Q. It is on page 3 in paragraph -----

MR. JUSTICE BELL: Just above 5, I think Ms. Steel has in mind.
       A. Right.

MS. STEEL: You say: "Shortly afterwards John was replaced by
