     2   Q.   When you did that, you had before the form in front of
     3        you?
     4        A.  Yes.

     6   Q.   You checked whether people were having breaks, your 10
     7        specimen ---
     8        A.  Yes.

    10   Q.   -- people.  Did you check on other occasions when you were
    11        not doing an in-store audit?
    12        A.  I did myself, yes, but you did not have to, you know,
    13        it was just -- you just had to check they had had a break,
    14        but obviously -----

    16   Q.   What were you doing that for then?  Why should you want to
    17        check that?
    18        A.  Because, obviously, you want to make sure, I suppose it
    19        is a conscientious thing, you just want to make sure people
    20        are not, you know, and on several occasions I would be
    21        asked to, you know, come to a Managers' meeting and tell
    22        them because you cannot really wait until an audit is
    23        done.

    27   MS. STEEL:  You said about the breaks checklist this morning,
    28        that we looked at, that you had seen it but had never used
    29        it, do you remember that?
    30        A.  Never used it for what, sorry?

    32   Q.   I do not know.  My note -----

    34   MR. JUSTICE BELL:  You were shown a sheet of paper which was a
    35        breaks check list and you said you had seen the sheet but
    36        you had never used it.
    37        A.  Yes, that audit is very different to the ones we use.
    38        It is a different type and everything.

    40   MS. STEEL:   Why had you seen it then?
    41        A.  Sorry?

    43   Q.   Why would you have seen it but never used it?
    44        A.  Because, well, I have never used the audit that I had
    45         -- I have never used an audit like that.  Ours are sent
    46        from Head Office.  I think that one was typed up.

    48   Q.   You also said that as regards the audit you would deduct
    49        five marks for someone taking either too short or too long
    50        a break.  Why would you deduct five marks for that? 
    51        A.  Because, obviously, people have to take their full 
    52        break.  They have to take a 45 minute break or a 30 minute 
    53        break or a 15 minute break.  That is what they have to do.

    55   Q.   Right.  Why was it that they had to?  Was that a specific
    56        instruction from somewhere?
    57        A.  Well, it is in the Crew Handbook.

    60        complying with the contract of employment?
