                                                                  DAY 212

                                             KIM MOFFATT, Cross-examined:

       A. What was in the Crew Handbook, yes.

MR. MORRIS: Do you know what it says in the Crew Handbook about
       breaks?
       A. Do I? Yes, I am not -- I could not reel it off the top
of my head but I have read it on several occasions.

  Q. When you were checking, as you did, and you reported back
to Managers, and this was part of your responsibility and
you were in charge of the paperwork and all this kind of
stuff, do you remember any of the exceptions to the
McDonald's break allowances that are specified in the Crew
       Handbook?
       A. Do I remember? Sorry, I do not really understand.

  Q. Do you remember any exceptions to the breaks that you
       specified, 15, 30 and 45 minutes, and then a 45 and 20, if
it is more than 10 hours shift, do you remember any
       exceptions to those breaks?
       A. So, do I remember anyone actually taking more than that
       off?

  Q. No, do you remember, are there any exceptions to those
       specified in the handbook?
       A. I am not sure. I have not got -- I would need a copy.

  Q. I am asking you if you remember.

MR. JUSTICE BELL: Do not be ashamed to say you do not
       remember. Lots of people ---
       A. No, not standing up here, I cannot remember.

  Q. -- open the manuals when they are doing tests just to ---
       A. Yes.

  Q. -- look and see and make sure they have got it right. If
can remember, good for you, but if you cannot, do not
       hesitate to say so.

MR. MORRIS: Right. You have been hat McDonald's how long?
       A. 10 years next year.

  Q. You have been doing orientations how long?
       A. Probably about six years.

  Q. Six years. You say that you actually physically read out
       the entire Crew Handbook?
       A. I did not say the entire, no, not the entire Crew
       Handbook.

  Q. You just skate through the main bits?
       A. There is an actual -- in the orientation checklist they
have main headings, and I will go through those and any
other bits that the employee wants to talk about, or I want
       to talk about.

  Q. OK. I do admit I was a bit was surprised when you said you
       read it out.
       A. No.
