DAY 212
KIM MOFFATT, Cross-examined:
Q. Just you read out specific sections or -----
A. Well, it is nearly the whole book except for -- there
is quite a lot of the book I do read out.

Q. Right. Presumably, you do not read out the exceptions to
the standard breaks allowances, otherwise you would
remember it?
A. Yes, but I cannot -- I cannot remember it standing up
here.

Q. It is not surprising that people that are employed by
McDonald's, especially as 66 per cent are under 21 or a
third of them are under 18, and they have never had any
experience of employment before, might not remember all the
complicated details of what they are entitled to; that
would not surprise you, would it?
A. No. They can keep -- they are always meant to keep the
Handbook on them. So, if I had the handbook on me, I would
be fine.

Q. There is no pocket in the uniform, is there?
A. No.

Q. Right.
A. Lockers, we provide lockers for them to keep them in.

Q. It is the employer's obligation, is it not, you said, to
check that people get the breaks they are entitled to?
A. The employer, yes.

Q. Yes. While on the subject of audits, you said you did some
audits of that Heathrow store. Do you remember roughly how
many you did in the time that you were there?
A. No, I cannot remember exactly, no.

Q. Was it four, was it seven, was it two?
A. Probably I would say about eight, nine.

Q. Eight or nine Human Resources audits?
A. Yes.

Q. You said you spoke to Semir Khazna -- Helen brought that up
briefly -- about this problem of under-18s and the altering
of the clock card, yes -- not the altering the cards, but
putting people on an hour before they worked to
compensate. Did you tell him what was going on, basically?
A. I told him about people working past midnight.

Q. You told him what was happening as regards the covering it
up, did you not?
A. No.

Q. You did not bother to tell him about that?
A. Well, I did not know for a fact. I just -- I knew it
must have happened because people needed to be paid. I did
not know for a fact because I did not do it myself.

Q. You did not tell him though that it must have been
happening?
A. I cannot -- I cannot recall that, no.
