                                                                  DAY 212

                                             KIM MOFFATT, Cross-examined:

it was put on the next day as an hour earlier, what would
       be the appropriate action?
       A. I am not sure. You would have to be a Supervisor to
answer that, I think, because I have never been at that
level so I would not really know.

  Q. No, but you are in charge of orientation and explaining the
Crew Handbook, so you, obviously, know the disciplinary
       procedures, yes?
       A. Yes.

  Q. What is the appropriate action for ------

MR. JUSTICE BELL: I must say, I found her last answer a
perfectly sensible one. It is a question of disciplining
people who are senior to her, and she has said she would
have thought that was something for the people senior to
them, like Mr. Khazna, the Supervisor.

MR. MORRIS: Are you aware that it specifies it is an of gross
       misconduct ---
       A. In the Crew Handbook, yes.

  Q. -- leading to dismissal for falsifying the hours that
       somebody worked at the store?
       A. In the Crew Handbook.

  Q. You are aware of that?
       A. Yes.

  Q. So that would be the appropriate action, would it not?

MR. JUSTICE BELL: No, does it say that?

  MR. MORRIS: Yes, it does.

  THE WITNESS: Yes.

MR. JUSTICE BELL: Does it say "gross misconduct leading to
dismissal", because my recollection is that it had one or
two extra words which might be vital.

MR. MORRIS: It is in the Crew Handbook. It says here:
"Examples of gross misconduct resulting in dismissals",
and "B" is "falsifying time cards".

MR. JUSTICE BELL: Yes, but are you suggesting that it actually
does lead to it or that it may do, because there may be a
       distinction -----

MR. MORRIS: It says: "The following are examples of dishonesty
and/or gross misconduct which will lead to summary
       dismissal".

THE WITNESS: Is it not subject to investigation or?

MR. JUSTICE BELL: I hope it is or McDonald's would spend all
its time before the Industrial Tribunal.

MR. MORRIS: Yes, the previous list, it is in the 1992
