                                                                  DAY 212

                                             KIM MOFFATT, Cross-examined:

about the crew payroll summary -- you remember that?
       A. Yes.

  Q. The sheets that we were looking at, everybody who is
employed by the store who is hourly paid, are they all
       included on that list?
       A. Yes.

  Q. Whether or not they did any work that week?
       A. Yes.

  Q. Right. You said this morning that if a crew member left
the store, for example, a student, then when they came back
they would have to rework the six months to get holiday pay
       entitlement?
       A. Yes.

  Q. That is if they are taken off the books, is it?
       A. Yes, that is if they are terminated.

  Q. Right. How long would their break in work have to be for
       that to apply?
       A. Well, if they actually leave and say, "I am leaving",
then you terminate them. I do not .....

  Q. But if they said: "OK, it is the summer break now. I am
going back to my parents'. I will be back in September or
October", or whatever, what about then?
       A. I am not aware that anyone that did that so I could not
       really say.

  Q. Are you aware of anyone doing that over the Christmas break
       or at any other times?
       A. I mean, going -- going away for how long?

  Q. That is what I am asking. How long would the break have to
       be before they were terminated?
       A. I could not really comment. I did not work with anyone
       who did that.

  Q. So people never said that they would be coming back at a
later date at the Heathrow store?
       A. Well, if they are leaving, then I could not see why
       they would be coming back.

MR. JUSTICE BELL: No. You are being asked, people, especially
if they are students, may have a reason for going away for
a period of several weeks or several months, but plan to
come back. In Ms. Steel's example, it might be that they
       were at college ------
       A. But if I did not work with any, I do not really .....

  Q. Yes, what you are saying is whether or not that actually
happens, you did not experience it so you do not know what
       the procedure would be?
       A. No. I know that if ------

  Q. Is that what you are saying?
       A. Yes.
