DAY 212
KIM MOFFATT, Cross-examined:
MS. STEEL: OK.

MR. MORRIS: Remember you say about people giving notice, it is
breach of contract. You said they have to give notice
otherwise it as a breach of contract ---
A. Yes.

Q. -- and they will not get the holiday pay?
A. Yes.

Q. How do you know it is a breach of contract? Is that
because it is in the Crew Handbook, that that is what you
must do?
A. Yes.

Q. Right. That is the document that you checked to find out
if someone is in breach of contract?
A. I do not know who was in -- I am not sure what you
mean. So, if someone leaves without telling us they are
going to leave, they just fail to show up for work or?

Q. I am just saying you said it was breach of contract that
you would not be entitled to your holiday pay, yes, but the
fact that that is a breach of contract, not giving you
proper notice and working notice, is that contained in the
Crew Handbook and that is why you know it is -----
A. Yes -- I did not say breach of contract, I do not
think, but, yes, it is in the Handbook.

MS. STEEL: Can you just explain why it is that you wanted to
become an Admin Assistant?
A. I just really enjoy doing paperwork. I enjoyed working
more with the people, you know, within the paperwork side
and I enjoyed orientations.

Q. Right. You said that you wanted a less pressurised job
than that of a Manager?
A. Yes.

Q. You had been a Second Assistant prior to that?
A. Yes.

Q. You had found it quite hard going?
A. Yes, you know, I get quite stressed quite easily, so
yes.

Q. Right. So a fast pace of work?
A. Not so much fast pace. Me, personally, as a person,
I am a lot happier doing paperwork than I am, you know,
running a restaurant.

MR. JUSTICE BELL: We have got to take the break at some time.
Five minutes.

(Short Adjournment)

MR. MORRIS: A couple of things. Did you ever get any specific
training to be able to do orientations?
A. Yes.
