                                                                  DAY 212

                                             KIM MOFFATT, Cross-examined:

       A. I do not know anything about unions. I think it is
       rubbish, really.

  Q. But it would make your job easier, would it not, if there
was a union at the store?
       A. No.

MR. JUSTICE BELL: Do you know whether it would make your life
       easier ---
       A. No, I do not think it would.

  Q. -- if there was union representation in the store?
       A. No.

MR. MORRIS: You would like, though, all the people that you
train and employ to know their rights?
       A. Of course I would, yes.

  Q. Their legal rights?
       A. Not -- I do not know much about legal things, so
       I could not comment.

  Q. You are just in charge of doing the orientation?
       A. Yes.

  Q. OK. Can I just ask you one question about when you were
going through the clock cards, checking on whether people
got their entitlement to a 45 minute break, or whatever
break it was that they were entitled to, what percentage of
people each day on average would you say would be about
normal for people not getting their entitlement break? Say
you had 70 clock card entries for the day on a clock card
file, how many of those would you expect, casting your mind
       back ---
       A. I would expect none of them -----

  Q. -- to have not got their entitlement on their break?
       A. I spoke to all of them to have 45 minutes, if that is
what they are entitled to. That is what I would expect,
       but -----

  Q. Yes. But I am asking what you actually saw when you
       checked?
       A. I cannot remember, I am afraid. I checked them daily.
       It is too many.

  Q. You checked them daily over the time that you were employed
       there?
       A. Yes.

  Q. You said that you did bring it up at Managers meetings from
time to time that people had not got the breaks they were
       entitled to; yes?
       A. Yes.

  Q. So most days there would be no infringement of what people
       are entitled to?
       A. One at a push. I just could not recall any.

  Q. About one a day, maybe?
