DAY 212
KIM MOFFATT, Cross-examined:
be honest. I believe we were told he started in February
94.

MS. STEEL: February to June.
A. Yes.

MR. MORRIS: But if we look at page 43, which is 10th April,
would that be a fairer cross-section of the employees in
terms of people getting pay reviews, or whatever, and
getting wage increases?
A. That is when they are proposed. That is when they
should have one.

Q. That is when they should have one. You cannot just propose
what they should get if they have not had a pay review?
A. No, you say they are ready -- you know, it is every
four months they have a pay review.

Q. It says: "The following rate charges were proposed during
the pay" -----

MR. JUSTICE BELL: "Changes" I think it is.

MR. MORRIS: "Changes", sorry.

MR. JUSTICE BELL: There are only some. I see "J. O'Brien" has
one.

MR. MORRIS: What page are we on?

MR. JUSTICE BELL: Page 43, and all the others have stayed the
same. He has gone up to 3.25. He has gone up 10p. So,
presumably, before his new rate he was 3.15?
A. Yes.

Q. All the others have stayed the same. Instead of putting
nothing at all in the differential plus or minus, they have
put the rate which is just the same ---
A. Yes, because they have -----

Q. -- except for him; he has, presumably, got 10p more rather
than 10p less?
A. They are actually proposed, though, they are not -- it
is the computer saying these people are due.

Q. Yes.

MR. MORRIS: Right. Of those due, only one of them actually got
it at that time?
A. On that -- they are actually due in the period so they
might have it either side of that after, you know, this
paperwork has been printed out.

Q. Considering the extent -----

MR. JUSTICE BELL: Can I just pause a moment?

MR. MORRIS: It might help to look through some of these.

MR. JUSTICE BELL: Let us make sure we are on the same ground.
