     1        If you look at page 43, what Mr. Morris is putting to you
     2        is that all the names there from Dillon H. Down to Fiara(?)
     3        G, are eligible -- correct me if I am wrong, Mr. Morris --
     4        for rate changes?
     5        A.  Yes.

     7   Q.   But, in fact, only O'Brien J. has got one?
     8        A.  Yes.

    10   MR. MORRIS:  Can I ask a question, this would be the official
    11        form where you would check if people are getting their pay
    12        rises on time?
    13        A.  One of them, yes.

    15   Q.   Is one of the documents that you check, is it, when you
    16        look through the -----
    17        A.  No, I use my other -- I use something else.

    22        wish to draw from that, just so there is no confusion.

    27        that all the others were eligible but did not get a rise,
    28        then put that.  If there is some other suggestion,
    29        conclusion, you would seek to draw, put it.

    31   MR. MORRIS:  I am just having a quick look at a few documents.
    32        Page 52, there are some more documents.  That is April 94.
    33        It seems that very few people who were eligible for a rise
    34        at a particular time were actually getting that rise, would
    35        you agree with that, from the documents we have looked at?
    36        A.  Yes.

    38   Q.   OK.  I just have to see if it is any different under
    39        Mr. Roberts.  They do not seem to be disclosed.  If there
    40        is a series of pages ------

    42   MR. JUSTICE BELL:  You see, it has in the penultimate column
    43        "date of change" and there are dates there, all of which,
    44        including O'Brien J., are within the pay period.  The new
    45        the new regular rate might indicate that they are on a new
    46        rate, but it is only O'Brien J. who has 10p, whereas the
    47        others have got the same rate under differential.  Are you
    48        familiar with this document?
    49        A.  No.  It is actually from Head Office so I just, you
    50        know, I just use the front panel for the payroll purposes. 
    51        I do not actually deal with this part.

    54        date they are actually due for a pay increase.
