     2   MR. JUSTICE BELL:  That may be right.  It may be right.

     4   MR. MORRIS:  Yes.

     6   MR. JUSTICE BELL:  But whether one draws that conclusion with
     7        confidence, I suppose, is a matter of comment.

     9   MR. MORRIS:  Yes.  (To the witness):  But everyone should get
    10        the pay review on time, should they not?
    11        A.  Yes.

    13   Q.   If anyone wants to check the Dave Roberts days on page 85
    14        and around that period, at the back there are a lot of new
    15        starters as well.

    17   MR. JUSTICE BELL:  That is page 383, 30th August 94, Payroll
    18        summary at the end.

    20   MR. MORRIS:  Page 81 is another one which is on 31st July,
    21        etcetera, etcetera, at the back.  For example, on page 81
    22        of six non-starters, i.e. not new people, 3 got a pay rise
    23        and 3 did not.  Anyway, I think just one more question.

    25   MS. STEEL:   Actually, this is going back over something which
    26        we started on this morning.  I just want you to turn to the
    27        orientation checklist.  Have you got it there?
    28        A.  Yes.

    30   Q.   Right.  If you read the first line:  "Tick each item as it
    31        is covered.  When your orientation is completed, sign and
    32        date at the bottom of the checklist".  Would you agree that
    33        appears to be an instruction to the person carrying out the
    34        orientation?
    35        A.  No, I could not, no.  I think it is the person that is
    36        actually reading this, the crew member.

    38   Q.   When a crew member starts they probably would not know what
    39        all these things were, would they?
    40        A.  No.

    42   Q.   There would not be much point in them having this to make a
    43        check of whether or not it had been covered?
    44        A.  Yes, I think it is quite -- obviously, I have to go
    45        through every single one of these and as they understand
    46        it, and only when they understand it, they tick it.  So, if
    47        they have got blanks, they obviously do not understand
    48        those and so we need to go through them again.

    50   MR. JUSTICE BELL:  Can you just pause a moment?  You say it is 
    51        directed at the employee, but the bottom of the checklist 
    52        has a place for employee's signature and a place for 
    53        Manager's signature?
    54        A.  Yes.

    56   Q.   So if I had been left to myself, I would have thought it
    57        was directed at both of them.
    58        A.  Yes, it is directed at me to go through it with them.
    59        It is directed at them to tick and sign.
