Day 213 - 31 01 96 - Page 19

                                                                  DAY 213

MR. MORRIS: Can we review that tomorrow to see what the
       situation is?

MR. JUSTICE BELL: Yes, but I see absolutely no reason why we
should have a gap between the McDonald's -- unless you tell
me Mr. Beech cannot come. Can he come?

MR. MORRIS: Yes. He will be here tomorrow.

  MR. JUSTICE BELL: Yes.

MS. STEEL: The only reason that we are a bit, kind of,
hesitant about that is because we are supposed to be having
a legal meeting tomorrow afternoon. In some ways it would
be quite helpful if we had a bit of time to prepare for
       that but ......

MR. JUSTICE BELL: Let us see. What I do not want to happen is
to risk not finishing Mr. Beech on Friday or have to rush
through his evidence in any way, or if you propose to take
a bit of time asking him extra matters in-chief, which
I will not stand in the way of, end up with Mr. Rampton
only having a short period to cross-examine on Friday when
we could perfectly well go on with Mr. Beech tomorrow if we
       have got to that stage.

We had to break off a witness last Thursday afternoon.
There was no alternative to that, but it is not a very
satisfactory situation because it is easier for everyone
when the details with regard to a particular restaurant is
       in everyone's mind.

So, what I would urge is -- we have got through the last
witness pretty quickly -- if everyone on both sides of the
court can show the same expedition and we can be prepared
to start Mr. Beech tomorrow, then we will avoid the risk of
him going over to another day for part of his evidence
which will be an achievement. Yes?

MR. RAMPTON: Mr. Plaister. That is Mr. Plaister,

                      STEPHEN PLAISTER, sworn
                    Examined by Mr. Rampton, Q.C.

  MR. RAMPTON:  Could you find -- it should be beside you;
Mr. Riley probably has it -- it is volume XB, and I think
that the tab you need is 39N.
       A. Which bit are we at?

  Q. N.

MR. JUSTICE BELL: 39. Divider 39?
       A. Yes, I have it.

  Q. Then an N.
       A. Yes, I have it.

MR. RAMPTON: Has it got your name at the top?
       A. Yes, it has got my name.
