3 Q. There was a problem when Mr. Riley was the Manager, was
4 there not?
5 A. I cannot comment on that, because I was not aware of
6 that.

8 Q. That was the reason you were brought in, to sort out the
9 problem?
10 A. The reason why I was called in was because John Nevison
11 had a problem with the crew hiring in the restaurant.

13 MR. JUSTICE BELL: Why do you not concentrate on what is
14 actually in the statement, because if you look at the top
15 of page 2, paragraph 4 -- look at the bottom of page 1
16 first of all. You say you took over in February 1994.
17 Bottom of page 1 -- do you have that? I am sorry.
18 Divider 39J, your statement. Look at the bottom of the
19 first page, paragraph 2. You took over in February 1994?
20 A. That is correct.

22 Q. Then paragraph 3: "My Operations Manager, Mark Twyser,
23 explained to me that I was being appointed as Supervisor in
24 order to improve the store." Presumably, he said that to
25 you before you actually took over?
26 A. That is correct.

28 Q. If you turn over the page: "It was immediately obvious to
29 me that there was a shortage of both management, team and
30 crew at the store." What Ms. Steel is putting to you is
31 that that was the position the moment you set foot there,
32 John Nevison only having taken over two days beforehand.
33 Do you understand?
34 A. Yes, I do.

36 Q. Do you agree with that?
37 A. I agree that there was not a sufficient amount of staff
38 in the restaurant when John Nevison took over.

40 Q. Just read through paragraph 4 and tell me, was that the
41 situation when you first went in two days after Mark Riley
42 became an Area Supervisor and John Nevison became the
43 Store Manager?
44 A. My initial findings, reading through this, on the day
45 I took over the Heathrow branch, were that the store was
46 short of Managers and there was not sufficient amount of
47 staff for the volume of that restaurant.

49 Q. That was the situation when you first went in as Area
50 Supervisor?
51 A. That is correct.

53 MS. STEEL: You thought there should have been six salaried
54 Managers, 12 Floor Managers and in the region of 160 crew?
55 A. That is correct, yes.

57 Q. So, if the store had been running at much less than that
58 during Mr. Riley's period as Store Manager, then the store
59 was understaffed?
60 A. In my view, yes.
