                                                                  DAY 213

                                            SEMIR KHAZNA, Cross-examined:

1 A. No, that is incorrect. Mark Riley was what we call a
2 General Manager, and some General Managers at the time were
3 looking after two restaurants. It is something that we had
     4 in the system.
     5
6 MR. JUSTICE BELL: Was that throughout the period when he was
7 responsible for the Heathrow store ---
     8 A. Mark Riley?
     9
10 Q. -- that he was General Manager?
11 A. I do not know the time period, how long he was a
12 General Manager of both the stores but, as I am aware, he
13 was running both of them; I do not know how many months
    14 though.
    15
16 Q. Ms. Steel has been careful to put "hourly paid" to you, we
17 know that includes Floor Manager?
    18 A. That is correct.
    19
20 Q. When you were given figures like 120 to 130 or 160 or
21 anything below 100, you have included Floor Managers in
    22 that, have you?
23 A. No, I did not include the management team, no.
    24
25 MR. MORRIS: You do say in your statement there should be six
26 salaried Managers, 12 Floor Managers and in the region of
    27 160 crew?
    28 A. That is correct.
    29
30 Q. The figure of 160 is the crew level?
    31 A. That is correct.
    32
33 MR. JUSTICE BELL: Yes, but I asked the question because
34 Ms. Steel asked a question which made me think that when
35 she was asking about the numbers of hourly paid, she was
36 including Store Managers, when all I am ------
    37
38 MS. STEEL: Floor Managers. That included Floor Managers, not
    39 Store Managers.
    40
41 MR. JUSTICE BELL: I meant Floor Managers, sorry. That is my
42 mistake. (To the witness): But when Ms. Steel was putting
43 numbers to you, she was including Floor Managers but, as
44 I understand it -- I am starting again now -- when you talk
45 about your evaluation and use figures like 120 or 130 or
46 160 or below 100, you are not including Floor Managers; you
47 are not including Floor Managers, you are talking about
    48 other hourly paid crew?
    49 A. Yes, I am ------
    50
51 Q. Is that right or not?
52 A. That is correct, I am including from training squad
    53 downwards.
    54
55 Q. Just pause a moment. So you have to add Floor Managers, a
56 sufficient complement of Floor Managers, to those figures?
57 A. To the crew level.
    58
59 Q. It is quite clear from your statement that when you say it
60 needed 160 crew, we have to add Floor Managers on top of

                                      44
