                                                                  DAY 213

                                            SEMIR KHAZNA, Cross-examined:

rise. Is that what that shows?
       A. I cannot -----

MR. JUSTICE BELL: I feel very wary about this, because this
witness has said that he is not sure, so the answer is
       bound to be unreliable.

MR. MORRIS: OK. Did you look into this issue?

MR. JUSTICE BELL: One thing we do see is, Mr. Patel got
10 pence, but I see from the bottom line he ended up only
getting five, because if he had got 10 it would have taken
him above the maximum for his post. That is just a passing
       detail.

MR. MORRIS: Right. So, when you looked into this problem store
to sort it out, what action did you take, if any, over
performance views and whether people were getting increases
they were due, things like that; or did you take no action?
       A. I would follow up on it to make sure the crew are
getting their PRs, because I would get these reports copied
       to me.

  Q. Do you remember what you did? Did you monitor the
       situation about performance reviews?
       A. I do follow up on it verbally, yes.

  Q. Did you in this case?

MR. JUSTICE BELL: Can you remember now whether you did or not?
       A. Seeing all the PRs that have been done?

  MR. MORRIS: Did you check?
       A. I did not check the paperwork in the store, no.

  Q. You said you relied on audits.
       A. The audits that are copied -----

  Q. Did the audits indicate that performance reviews were not
       being done regularly?
       A. Yes.

  Q. They did?
       A. It tells you if people are not receiving PRs.

  Q. Did the audits for this store, when you came in to sort and
improve the store, as you say, did they show that PRs were
       not being done on time?
       A. There had been occasions where some PRs had not been
       done on time, yes.

  Q. That is what the audit said, was it?
       A. The names, yes, on the audit, yes.

  Q. So, did it identify that there was a problem with
       performance reviews?
       A. Of not being done on time?

  Q. Yes.
       A. Yes.
