                                                                  DAY 213

                                            SEMIR KHAZNA, Cross-examined:

rate for any store? I mean, it actually goes up in this
store between 3.35 and sometimes it is 3.41, you can see on
different pages, but if I look at the very last rate, the
       last page 99 has 3.40?
       A. Sorry, is that 99?

  Q. It is on page 99.
       A. Yes.

  Q. It seems to float around that figure. I mean, page 2 has
       got 3.35, page 5 has got 3.37?
       A. Sorry, are you just looking at the regular or the ---

  Q. The regular, the basic regular hourly rate.
       A. -- overall, are you looking at the overall average
       rates?

  Q. No, I am looking at the basic regular hours.

MR. JUSTICE BELL: No, the average hourly rate, taking no
account of evening or premium ---

  MR. MORRIS: Right.

  MR. JUSTICE BELL: -- pay.

MR. MORRIS: Because, obviously, some people would not get
       unsocial hours.

MR. JUSTICE BELL: It is suggested that you have been pointed to
two sheets where it was £3.40 an hour. We know that
starting was 3.15. Mr. Morris says that, according to his
researches, the figure various over the period we have
documents from between 3.35 and 3.41.

MR. MORRIS: Something like that anyway. On page 42 it says
       3.38.

MR. JUSTICE BELL: Do not worry. That is your ground. Ask your
       questions on that.

MR. MORRIS (To the witness): Would that be about average for a
store, in your experience, I mean, about that time?
       A. It depends on the age of the store.

MR. JUSTICE BELL: I know it does.
       A. There are -----

  Q. All you are being asked, you see, you were responsible for
half a dozen stores or a handful of stores and what
Mr. Morris is asking you is would that be pretty typical?
       A. It is round those figures, between 3.40 and 3.15.

MR. MORRIS: Right. So are you saying that this store was
       basically under the average?
       A. In my experience with the stores I have got, yes.

  Q. Yes. But something between 3.40 and 3.15 would be typical
for the average hourly rate -- you have just said that?
       A. Yes.
